DM ME TO ASK ABOUT COMMISSIONS
Terms of Services
1. You must be of or over the legal Age of 18 to commission me.
If I find out you are a minor during the Commission process, I will immediately cancel your Commission and blacklist you.
2.I reserve the right to decline a Commission for any reason.
3. I only accept Payment via PayPal Invoices. The Client is responsible for the Payment Fee.
4. Payments must be made in Eurus (€)
5. Payment Plans are only available for Orders totaling more than 100€.
6. Commissions must be paid within 72h after sending the Invoice, or the Commission will be canceled.
7. Up to 3 Adjustments are allowed within a Months time, any more will result in further Fees.
8. Deadlines will have to be made clear while requesting a Commission. Deadlines of 2 Weeks to a Month add a fee of 50€.
9. Should the agreed-upon Deadline not be met, a partial refund is given based on the progress % of the Product.
10. All Commissions will be created in my Style, i will NOT be adapting to the Style of other Artists, Games or Animations.
11. I retain all my rights to my works. Do NOT claim the Works as your own.
12. Unless otherwise agreed to in writing, all the Artwork will be created for personal, non-commercial purposes only.
13. You may NOT:
- Commission another Artist to edit my Artwork or use it as a Base without my Permission.
- Use the commissioned Art from me as Training Data for any AI Generator in any way, shape or form. Should you decide to want those rights, you will need to buy the exclusive commercial right for the Piece. Prices for these rights are seperate from the Commission Price.
- Re-sell my Works as an NFT or be involved in Crypto.
- Edit, trade, remove or crop out any watermark/signature or submit the Artwork in any kind of Contest.
- An exception to the above Term is cropping Artwork for usage as a social media icon or thumbnail.
14. You may repost the Artwork that you have paid for. This may be done to any Website you would like, as long as you link back to my Portfolio/Website.
15. When I'm working on your Commission, I will have regular contact with you to show WIP's. Your feedback is appreciated! If you take too long to respond (days or even up to weeks), I will push you to the end of my Queue or even cancel it.
16. After delivery of the Product, all rights to refund is void, since these are Digital Products. If you ask for a refund during the Commission process, I can only refund depending on the progress % of the work. The cost of premade assets used in your Commission cannot be refunded once purchased.
18. I will post WIP's and finished Commission Works on my socials. If you wish to keep your project private, please let me know beforehand!
By buying my Work, you automatically agree to my TOS, NO EXCEPTIONS.
2D Art
1. Once Sketch got approved, you will be send an Invoice.
2. By making a Payment, you attest that everything in the Sketch is acceptable and is within the guidelines specified in this TOS.
3. I will NOT draw:
Political, Gore, Hate, Religious, Heavy NSFW, Fetish, Mecha, Other Art Styles, NFT and/or AI
4. Your Finished Illustration will be uploaded to a Google Drive, along with a web-friendly Version and have the link send to your E-Mail.
3D Art
1. I will only ask for Payment when I'm ready to work on your Commission. If you force your money into my account without my approval, i will refund and cancel your Commission immediately.
2. I will only work on the Model once it's fully paid. I might be able to start with a down payment, depending on if there's a Payment Plan.
3. I will ask for proof of Purchase of bought Assets/Models that you want me to work on. Sending a Screenshot of the Receipt or the E-Mail from GumRoad/Jinxxy/Payhip will suffice.
4. If it is a Model Work Commission, I will only pass the commissioned files over (texture files, asset FBX, etc). However i can provide the Unity Package, or upload directly to your Account if you'd prefer (Log in details are required for uploading to an Account, please give a temporary password)
5. You are allowed to edit and customize the finished Model for personal use. If you wish to make certain stuff puplic or share with friends who own the same assets, let me know so I can discuss with you if I'm able to make that possible.
6. Personal usage for V-tubing/streaming and to port to other platforms such as Neos and Chillout VR is allowed!
7. Do NOT resell or redistribute the Model or parts that I have worked on. For the Model Bases that isn't from me, refer to the original Creator's TOS.
8. Once the Product is delivered to you, it will be your responsibility to keep the working files. I will delete files on my end after a few months to save space on my PC and hard drive. If I still have the files, feel free to request them from me!
9. I will not work for anyone who is going to use the commissioned Product with malicious intent. I am not responsible for any misuse of the Model or administrative actions taken against you.
10. If you do chargeback on a product/service that is all done and provided to you without discussion with me beforehand, I will revoke the rights for you to own and use the asset made for your Commission. The Asset will be made public for others to purchase or use and you will be permanently blacklisted.
